Do International Patents Exist?



Sadly there is no one size fits all international patent that will protect your invention in every country across the globe. Applying for a patent in the US will only protect you in US territory, and the same goes for other countries. If your goal is to sell or do business on an international scale, you’ll need to obtain patents in each country you wish to do business in.

There are a few countries that have grouped together and streamlined the patent application process. In these groups, which are mainly in Europe, you will still have to pay an application fee to each country.

The first step when seeking international patents is to decide what countries you need patent protection in. Then prioritize that list and determine which countries you should start the patent application in first.

One thing you might consider for an international patent is filing a Patent Cooperation Treaty (PCT). The World Intellectual Property Organization is the entity in charge of processing PCT applications. There are several advantages a PCT offers that a patent lawyer can go over with you to decide if a PCT is right for you. A PCT is not actually a patent, so you’ll still need to file a patent application in each country.
